These Terms and Conditions ("Terms") govern your access to and use of the mctga.org website (the "Site"), which is operated by Mountain Conservation Trust of Georgia ("MCTGA," "we," "our," or "us"), a nonprofit organization incorporated in Georgia, USA. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site.

These Terms apply to all visitors and users of the Site, regardless of whether you submit information through a contact form or simply browse the Site's content.

2. About Our Organization

Mountain Conservation Trust of Georgia is a nonprofit organization whose mission centers on land conservation in Georgia. Our Site functions as an informational and portfolio resource, describing our programs, conservation work, and organizational information. Our Site includes contact and inquiry forms that allow you to send us a message. By submitting a form, you represent that the information you provide is accurate and that you are authorized to share it. You acknowledge that submission of a form does not create a legally binding contractual relationship or guarantee a specific response or outcome. We will make reasonable efforts to respond to inquiries in a timely manner, but we cannot guarantee response times.

6. Embedded Donation Form

Our Site contains an embedded donation form provided by Little Green Light, a third-party donor management service. Your use of that form is subject to Little Green Light's terms of service and privacy policy in addition to these Terms. MCTGA does not collect or store your payment information. Any financial transactions you conduct through the donation form are processed by Little Green Light and its payment subprocessors. We are not liable for any issues arising from the third-party donation form, including errors, outages, or security incidents on Little Green Light's systems.

7. Third-Party Links and Content

Our Site may contain links to websites operated by third parties, such as conservation partners, government agencies, or news outlets. These links are provided for your convenience and information only. We do not endorse and are not responsible for the content, accuracy, or practices of any third-party website. 9. Limitation of Liability

To the fullest extent permitted by applicable law, Mountain Conservation Trust of Georgia, its officers, directors, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising from or related to your use of or inability to use this Site, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from your use of this Site, regardless of the form of action, shall not exceed fifty dollars ($50). 10. Hosting and Platform

This Site is hosted and operated on the Squarespace platform. MCTGA does not own or operate its own web servers. Squarespace may experience downtime, service interruptions, or feature changes that affect this Site. We are not liable for any interruption in Site availability caused by Squarespace's platform operations or by events outside our reasonable control, including but not limited to natural disasters, cyberattacks, or internet infrastructure failures.

11. Privacy

Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect information you provide to us or that is automatically collected when you use the Site. 12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Site shall be submitted to the exclusive jurisdiction of the state or federal courts located in Georgia. You consent to personal jurisdiction and venue in such courts.
